1. Introduction
These Terms of Service ("Terms") form the agreement between you and MVM Solutions, a sole trader based in Amsterdam, the Netherlands ("Tabsnap", "we", "us", "our"), about your use of the Tabsnap iOS app and the tabsnap.app website (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility
Tabsnap is available worldwide. To create an account you must be at least 16 years old. This is the digital-consent age under Dutch GDPR implementation (the Netherlands is our primary market) and also meets the GDPR default across the EU. If you are under 16, you may only use the Service with the explicit permission of a parent or legal guardian who accepts these Terms on your behalf.
You must also have the legal capacity in your country of residence to enter into this agreement.

3. Accounts
To use Tabsnap you create an account through phone number authentication. We send a 6-digit one-time password (OTP) to your phone number over SMS, and you enter that code in the app to verify the account. Your phone number becomes your account identifier. You are responsible for:
Agreement to Terms
Keeping your Apple ID secure.
The accuracy of the information you provide.
Any activity that happens through your account.
You can delete your account at any time. Open the app, go to Settings, and tap Delete Account. Deletion cascades across our database and storage. There is a 30-day grace period during which you can ask us to restore the account. After 30 days the deletion is permanent, except for a pseudonymous user ID retained in the audit log for 12 months, as described in our Privacy Policy.

4. Acceptable use
When you use Tabsnap you agree not to:
Use the Service for any unlawful purpose or to upload illegal content.
Upload content that infringes someone else's rights, including receipts that contain other people's personal data you are not entitled to share.
Abuse, harass, or defraud other participants on a bill.
Reverse-engineer, decompile, or attempt to extract source code from the app, or probe the Supabase or Anthropic services we rely on.
Run automated scrapers, bots, or load tests against the Service without our written permission.
Interfere with the Service, bypass rate limits, or try to circumvent our security controls.
Resell, sublicense, or commercially exploit the Service outside of the intended bill-splitting use case.
We may suspend or terminate accounts that violate these rules, with notice where feasible.

5. Content and your data
You keep ownership of the content you put into Tabsnap. This includes the receipt images you upload and the bills and items you create.
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and process your content, strictly for the purposes of:
Running the Service for you and the participants on your bills.
Parsing receipt text through Anthropic's Claude Haiku model (only text, not the image).
Backing up the data.
Providing troubleshooting and support.
This licence ends when you delete the content or the account, subject to the retention periods in our Privacy Policy.

6. Payments and bill-splitting disclaimer
This section is important. Read it carefully.
Tabsnap does not process payments. All payments between you and your bill participants happen outside the app, through your own banking app or payment provider, using tools like iDEAL, SEPA transfers, Tikkie links, Apple Cash, or similar.
Tabsnap is not a payment institution and is not licensed under PSD2. Tabsnap is not a money remitter, money holder, or account information service provider. We only record payment intent and payment-status markers that you (or the host) input manually.
Any dispute about whether a payment was actually made, how much was owed, or whether a split was fair, is a matter between the participants. Tabsnap is not a party to that dispute and does not guarantee, mediate, or underwrite any payment.

7. Paid services
Tabsnap version 1.0 has no in-app purchases and no paid tiers. The Service is free to use at launch.
We plan to introduce an optional paid tier in the future (expected around €2.99 per month). When we do:
The paid tier will be clearly labelled inside the app.
Purchase and billing will run through Apple's In-App Purchase, under Apple's standard terms.
You can cancel at any time through your Apple Subscription Management settings.
We will publish the paid tier's specific terms before you subscribe.
For paid-tier users, our liability cap in Section 10 is adjusted: total liability is capped at the fees you paid us in the 12 months before the claim, with a minimum of €100 rather than €50. Rights you hold under mandatory Dutch or EU consumer law are not affected.
As a consumer in the EU you have a 14-day right of withdrawal after you subscribe (Directive 2011/83/EU, as implemented in Dutch law in Burgerlijk Wetboek 6:230o). If you want to use digital services during that period you may be asked to agree to start the service early and to waive the withdrawal right to the extent already performed, in line with 6:230p BW.

Your content remains yours. Section 5 describes the limited licence you grant us to operate the Service.

10. Disclaimer of warranties and liability
The Service is provided "as is" and "as available". Within the limits allowed by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent allowed by law:
Our total liability for any claim arising from or related to the Service is capped at the fees you paid us in the 12 months before the event giving rise to the claim. For free-tier users this cap is €50.
We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or missed payments between participants.
Nothing in this section limits our liability for fraud, intentional misconduct, or gross negligence, or for anything that cannot be limited under Dutch law.

11. Consumer rights carve-out
If you are a consumer in the EU or the Netherlands, nothing in these Terms affects your non-waivable statutory rights, including:
Statutory warranty for digital content and services: under Burgerlijk Wetboek 7:17 BW and EU Directive 2019/770 (implemented in Dutch law in Boek 7, Titel 1a BW), we owe you a Service that conforms to the contract. If it does not, you can ask for it to be brought into conformity (repair or replacement), a reduction in price where a price has been paid, or termination of the contract, on the conditions and within the timelines set by law. For paid digital services the statutory liability period is at least two years from delivery.
Right of withdrawal for paid subscriptions: under EU Directive 2011/83/EU (implemented in Dutch law in Boek 6, Titel 5, Afdeling 2B BW), consumers have a 14-day withdrawal right for paid digital services. See Section 7 for how this works if we launch a paid tier.
Unfair terms protection: under the EU Unfair Contract Terms Directive (93/13/EEC) and the related provisions of Dutch law (Burgerlijk Wetboek 6:231-6:247 BW), any clause that is unfair to consumers is not binding on you.
Mandatory consumer rules in your country of habitual residence: where you are a consumer in another EU member state, the mandatory consumer-protection rules of your country apply on top of these Terms (Article 6 Rome I Regulation).
Where a clause in these Terms conflicts with those rights, the statutory rights prevail and the conflicting clause is read down to the extent necessary.

12. Termination
You can stop using the Service and delete your account at any time (see Section 3).
We can suspend or terminate your account if you materially breach these Terms, if required by law, or if your continued use poses a genuine risk to the Service or other users. Where reasonable and feasible we will give you notice and a chance to fix the issue first.
If we terminate your account, Sections 5 (content licence, as relevant to existing backups), 8 (IP), 10 (liability), 11 (consumer carve-out), and 13 (governing law) survive.
